The following Terms and Conditions (‘Terms and Conditions’) are valid between you and Denham The Jeanmaker B.V. (‘Denham/we/us’) and apply to all use of and orders placed on all websites (www.denhamthejeanmaker.com, www.denhamthejeanmaker.com/de/, www.denham.com, www.denham.com/eu-de/, www.denham.com/uk-en/ and www.denham.com/us-en/), apps and other benefits and services offered by Denham (together, 'Denham' or our 'Service(s)'). By using the Services and/or placing an order on the Services you confirm that you have read and accept the Terms and Conditions. All Services are offered by Denham the Jeanmaker B.V. (Chamber of Commerce nr: 57908680), located at Tt. Vassumweg 95 (1033 SG) Amsterdam, The Netherlands.

We may change the Terms and Conditions from time to time without notice. You are responsible for keeping updated with changes in the Terms and Conditions. Please note that the Terms and Conditions that are valid for your order are always the Terms and Conditions in effect as of the time you place your order, and not a later version. You should file a copy of these Terms and Conditions on your computer.

Access to this Service is permitted on a temporary basis. We reserve the right to withdraw or amend the services without notice. We will not be liable if, for any reason, the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

By placing an order, you are offering to purchase an item on and subject to the Terms and Conditions. All orders are subject to availability and confirmation of the order price.

3.1. Eligibility to order
To place an order with Denham, you must be at least 18 years old, be a consumer (not a reseller) and possess a valid credit or debit card issued by a bank acceptable to us. When placing an order you undertake that all details you provide to us are true and accurate. Parental or guardian consent is required for customers under the age of 18. The name and telephone number of the person giving consent shall be entered in the message box at the checkout.

3.2. Order confirmation
When you place an order on our Service, we will send you an order confirmation email. Please note that the confirmation email is an acknowledgement that we have received your order, but it is not an acceptance of your order.

Once you have checked out and have received your order confirmation email, neither you nor we will be able to make any changes to your order, so please make sure that everything is correct.

3.3. Acceptance and shipping confirmation
All orders placed by you are subject to acceptance by us. Once the order has been processed, a shipping confirmation email will be sent with all relevant information about your order. The shipping confirmation is our acceptance of your order.

By placing an order with us, you agree to receive
communications from us either via email or text message and will be
automatically added to our mailing list. You must manually unsubscribe from our
newsletters to opt out of our communications. 


3.4. Right to reject
We may, at our discretion, choose not to accept your order for any reason without any liability to you. Examples of when we may not accept your order are as follows:

The product ordered is unavailable from stock;
Our inability to obtain authorisation of payment;
The identification of an error within the product information, including price or promotion;
If we suspect any fraudulent activity;
If shipping restrictions may apply to a product.

If we are unable to deliver within accordance to the terms in the confirmation, we will contact you and give you the opportunity to cancel the order. If we have already received payment, we will refund you the amount.


3.5. Quality of products
We aim to describe the item(s) on the Website as correctly as possible. However, as a result of different image acquisition, display technologies, or other technical reasons, minor differences in colour and other variations in item(s) are possible. Denham cannot be held responsible for any such discrepancy.

4.1. Price
The prices shown on the Website include Dutch VAT of 21%. Prices are quoted in Euro (EUR) and do not include service, payment, or delivery.

The prices shown on the Service may vary from time to time. Denham is not bound by the price until Denham has accepted the order by sending the shipping confirmation to you. Denham reserves the right to change, limit, or terminate any special offers or discounts at any time. Please note that the prices between our physical stores and the Website may vary.

4.2. Price changes
We always try and ensure that all prices on the Service are accurate, however, errors may occur. If we discover an error in the price of any item(s) which you have ordered, we will notify you by email about the price change and give you the option to reconfirm your order at the correct price or cancel the order. If we are unable to contact you, your order will be cancelled. Denham reserves the right to cancel any order prior to our acceptance of the order. If we have already received payment for a cancelled order, we will refund you the amount of the purchase. We are not able to compensate price differences with placing orders or returns.

The price of an item I ordered online has changed. Can I get the difference back?

Unfortunately, it is not possible to receive a partial payment back if the price on an item has changed during a sale period. If the item is still in stock online, you can choose to return your item for a refund. If prices have changed for any other reason, then please contact our customer service team.

4.3. Promotional code disclaimer
Promotional codes are only applicable on full-priced items, not on sale items. For further details, please check the code’s full terms and conditions.


Voucher codes are applicable on an order containing both full price and sale items. The value of a voucher code with an amount will be divided per product when the order contains 2 or more items. For an order of only one item, the amount will be deducted from the item’s total price. After a return, the refunded amount will not include the amount paid by voucher, but will be in the form of a new voucher. Please contact our customer service, who will provide you with a new voucher code.


If you are still having trouble using your promotional or voucher code, please contact our Customer Service Team and we will provide you with a new code.

Discount and voucher codes cannot be applied on orders that have been placed and paid for already.

Collaborations are excluded from promotions and discounts.

4.4. General sale/promotions disclaimer
Unless otherwise stated, the final price already reflects any discount. All sale items are limited to available stock. DENHAM reserves the right to change discount and offers on products without any prior notice.

4.5. Payments
We accept payments with Visa, MasterCard, Paypal, and iDeal.

When paying by card you will be asked for the card number, its period of validity and the CVC code. We make use of MasterCard SecureCode and SSL encryption, which prevent unauthorised access to card details. We do not store card numbers after the transaction has been completed. For more information, you can take a look at our Privacy Policy.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason, authorise payment, then you will be notified immediately at the checkout.

4.6. Tax
Please note that local charges (customs duty, sales tax) may apply, depending on your region and local customs duties. The charges are at your own expense.

5.1 Shipping details
We provide shipping using our partners BPost, Budbee, Colissimo, DPD, GLS, PostNL, Royal Mail, and UPS. Shipping rates are applied per order. The exact shipping rates depend on the country to which your order is being delivered. All packages are insured and have a tracking number so the package can be tracked. This tracking number will be shared in the shipping confirmation email.

5.2. Shipping costs and delivery time
We provide free EU delivery for orders over €160 and to the US for orders over $300. For orders below we calculate respectively €3.95 (Belgium, France, Spain & the Netherlands), €4.95 (Austria & Germany), €5.95 (Luxemburg), €9.95 (Czech Republic, Italy & Poland) and $50.00.

For orders to the UK, we charge a £15.00 delivery fee.


We aim to deliver your order within the number of days shown for your country in the table above. However, sometimes deliveries may take longer, particularly during busy sale periods. Saturday and Sunday are not considered working days. If you have not received your delivery within the number of days shown for your country in the table above, please contact our Customer Service. Please note that we are not held responsible for any delays resulting from postal delays.

6.1 Right of return

You have the right to return unused purchased items within 15 days, without giving any reason. To exercise this right, use the Return Form and included it in the package you received. You cannot return items ordered through our Website at one of our physical stores.

Return costs are at your own expense for the Netherlands and the United States. Free returns for the other countries.
If you are returning a parcel from outside the European Union, please ensure three Commercial Invoices are placed inside the parcel. You can find them here.
That’s it! Once your return parcel has reached our warehouse, we will process your refund immediately. Please note it may take up to one week for the refund to appear (depending on your original payment method).


All original packaging with pricing, labels, and hangtags must be intact. No tape is to be attached to the product or the item(s) packaging. All item(s) must be returned in a box to protect their form. Returns that do not meet our policy will not be accepted and will be returned to you.

Underwear can only be returned if they are unopened in the original packaging, unworn and in original state - with all the labels attached.

6.2. Refund information

If you return your entire order, we will refund all costs including the original delivery costs. If you return a portion of your order (ie: one of three products you purchased), we will reimburse you for the cost of the returned item only. All reimbursements will be paid within 10 days from the date we receive the returned product(s). We will reimburse you using the same method of payment that you used to make the original transaction unless we arrange a different method with you; you will not be charged any fees for such repayments under any circumstances.

All Denham item(s) come with a one-year warranty against faults in materials and manufacture. This warranty period may vary depending on the statutory law of the country where the item is shipped. This warranty covers production faults, but not wear-and-tear from regular use.

If you believe you have a warranty claim concerning an online purchase, please contact Customer Service. Send them an email and include your original order number, photos of the suspected fault and a brief description of the claim. They will decide whether the damage is the result of a manufacturing defect or deviation from factory specifications. If they determine that you have a claim the item(s) will be refunded.

8.1. Errors, inaccuracies and omissions
Occasionally there may be information on our Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, and availability. At any time and without prior notice, we reserve the right to correct any errors, inaccuracies or omissions; change or update information, or cancel orders if any information is inaccurate.

8.2. Intellectual property rights
All elements on the Website are owned by or licensed to Denham and its affiliates. All elements of the Website including (but not limited to) the general design and the content, can be protected by copyright, moral rights, database rights, trademark and other laws relating to intellectual property rights.

You are authorized to use this material only for personal, non-commercial purposes. You may download, print and store copies of this material for your own personal, non-commercial use. You may not publish, duplicate, distribute or otherwise reproduce the content to others without prior consent from Denham.

8.3. Limitation of liability
Denham will not be liable for any indirect, direct, additional or consequential damages that may result from the use or content of our Website, including damages caused by viruses or any incorrectness or incompleteness of the information on the Website; the performance of the products; or otherwise arising in connection with the use of these Terms and Conditions, even if Denham has been advised of the possibility of any such damages.

8.4. Third parties
On our Service(s) you may find third party links that direct you to third-party websites that are not affiliated with us. We are not responsible for these links or for any loss or damage that may arise from the use of them. These websites have their own separate Terms and Conditions as well as privacy policies. Denham is not responsible and cannot be held liable for the content and activities of these websites.

8.5. Invalidity
Each provision of the Terms and Conditions shall be construed separately and independently of each other. If any provision is deemed invalid, void or otherwise unenforceable, that provision shall be deemed severable from and shall not affect the enforceability of any of the other provisions of these Terms and Conditions.

8.6. Privacy Policy
By placing an order you agree and understand that we may collect, use, store and process your personal information in accordance with our Privacy Policy.

These Terms and Conditions are in accordance with the laws of the Netherlands. In the event of a dispute or claim associated with these Terms and Conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Dutch Courts.

Denham has implemented a variety of security measures to maintain the safety of your personal information. All payment information provided by you is transmitted via Secure Socket Layer (SSL) technology, which encrypts your information before it is sent to us to protect the information from unauthorised use. Besides SSL encryption, we use MasterCard SecureCode, which represents an extra level of security for you when placing an order. It protects you against the misuse of your card number. All payment details are processed through a gateway provider and are not stored or processed on our servers. Although we will do our best to protect your personal information, security cannot be guaranteed.

5.2. Third party links
Our Devices may include links to external websites operated by other companies. These third-party links may collect personal information from visitors to their website. Denham has no responsibility or liability for the content and activities of these linked websites.

5.3. Retention of your information
We retain your personal information for as long as necessary to fulfil the purposes for which we collect it, except if the law requires otherwise.

5.4. Location of your information
The storage of data processing is mainly in Europe, offering an adequate and appropriate level of protection. Only for our newsletters (mailing campaigns), we use a third party tooling Mailchimp that is located in the USA, however it meets the GDPR requirements (https://mailchimp.com/help/about-the-general-data-protection-regulation/).

5.5. Data protection rights
Our Devices generally present you with the option to add, update or remove information we have collected about you. If any information we have about you is not accessible through our Websites or Apps, you can send a request to our Customer Service for access to, update or to remove this information.
After receiving your request, we will verify your identity and provide you with an overview of the information we have about you. If you have received this information, you may ask us to make adjustments to certain information that is incorrect or remove certain information. Additionally, at any time you can revoke, effective for the future, your given consent for the newsletters and other advertising. With regard to the processing of your personal data, you also have the right to approach the responsible data protection authority – the Hamburg Commissioner for Data Protection and Freedom of Information.

5.6. Email subscription
You can register for our Denham newsletter by submitting your email address in the newsletter module found at the bottom of any page on the Website or in the newsletter pop up. We don’t send the newsletter to online (or registered) visitors unless you have chosen to receive this. All of our email communication contains an unsubscribe button, so at any time you can easily opt-out from receiving future emails. You may also contact us to exercise your rights via our contact details.

When you visit our Devices, unique cookies are placed to distinguish your browser from all other browsers that visit our site. By recognizing your browser, we can serve you better. By replying with #yesdenham and providing your permission, you represent and warrant that you own the image, and there are no other entities with ownership claims over it. You grant DENHAM the Jeanmaker a non-exclusive and non-revocable commercial right to reproduce the image in any form (including, but not limited to, video, internet posting, reproduction, display, email, publication, and distribution), either through DENHAM's own services or services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation. You agree that your image may be used by DENHAM the Jeanmaker either alone or in conjunction with sketches, cartoons, captions, films, artwork, textual matter, or other photographs. While DENHAM the Jeanmaker may make commercially reasonable efforts to give you credit for your photo and provide a link back to your Instagram account, you agree that such credit is not mandatory and your permission for us to use your image is not contingent upon such credit being given.

You waive any right to inspect and/or approve the finished work incorporating the image or the advertising copy that may be used in connection therewith, or the use of which said finished work might be applied. Further, you waive any claims to royalties with regards to your image or our finished work.

Last, you agree that if any provision or any portion of any provision, contained herein is determined to be invalid under any statute or the rule of law, then it shall, to that extent alone, be deemed omitted, and the remainder of this Permission to Use Image Agreement shall remain in full force and effect. This Permission to Use Image Agreement shall be governed by the laws of the Netherlands.

If you don't agree to these terms, we completely understand, and no further action is required.

In consideration of the possible publication of my photograph(s) submitted to DENHAM the Jeanmaker, I, the photographer, agree to the following:


LICENSE: As the owner of this image I grant permission to DENHAM the Jeanmaker and those acting on its behalf to use the images of me for all manner of advertising, trade, promotion, exhibition, or any other lawful purpose including but not limited to DENHAM the Jeanmaker catalogs, internet websites, email promotions, retail store displays and graphics, direct mail, print advertising, public relations, packaging, webcast/broadcast and in any form or medium in conjunction with the products and services of the Company or the image of the Company itself. I understand that DENHAM the Jeanmaker may alter the image in which I appear for use in its catalogs, web pages, and elsewhere. I hereby waive any right that I may have to inspect or approve the finished images, photographs, motion pictures, products, services, or the advertising or other copy that may be used in connection therewith or the use to which may be applied. The rights granted, and waivers and consents given herein are unlimited in time and worldwide in scope.


REPRESENTATIONS AND WARRANTIES: I represent and warrant: (1) that the Photographs are my original work; (2) I have not copied the Photographs from other images; (3) I have obtained written signed release(s) from each subject (or legal representative of any minor or pet) who appears in the Photographs or have authority (they are my pets and kids) to release rights on behalf of each subject and do hereby release rights on the subject's behalf.


MISCELLANEOUS: This Agreement will be governed by the laws of the DENHAM the Jeanmaker, and any disagreement arising out of it must be heard in a Netherlands court.



DENHAM

This protocol applies to Denham The Jeanmaker B.V. (“Denham”). Denham is responsible for processing of the data and is therefore considered to be the data controller.

This protocol sets out how Denham records, collects, uses and stores images of camera’s that are installed by Denham in and around its properties, offices and/or stores. Cameras are hereafter also referred to as: “CCTV”.


Denham uses camera surveillance for:

  • Access control to properties, offices and stores;

  • Monitoring of Denham offices, stores, (prospect) customers, employees, suppliers and other visitors to guard against theft;

  • Security of Denham properties and offices, stores, its (prospect) customers, guests and its employees against unauthorized access and other unwanted activities (especially in unmanned locations);

  • It may register and identify unauthorized persons and persons who engage in other undesired activities.

  • everything that is directly related to it.

The use of camera images must align with the purposes set out above, unless necessary in the interests of preventing, investigating and prosecuting criminal offences.

The camera images should not be used to assess how employee’s function.

Denham management has according the Procedure on camera systems which is part of the Privacy Policy of Denham appointed the Retail Manager to take overall responsibility for CCTV usage in the stores in accordance with the attached applicable (local) retention period and the legal requirements. The Data Privacy Officer or the employee responsible for privacy supervises the correct use of the camera images.

Denham management has according the Procedure on camera systems appointed the Human Resource Manager to take overall responsibility for CCTV usage in offices of Denham. The Data Privacy Officer or the employee responsible for privacy supervises the correct use of the camera images.

Location of the cameras is around the properties of Denham at Hellingbaan 432 (1033 DB) Amsterdam.

When installing CCTV, Denham takes into account the following:

  • cameras are installed in places where they are visible to those involved and only in places where CCTV has proved necessary.

  • Denham does not use hidden cameras (it has placed CCTV-signs around the properties and the stores).

  • The cameras are not directed at public spaces unless this is unavoidable to protect the products and people that Denham oversees.

  • Cameras are not placed in places that are private, such as toilets, changing rooms and homes, or in places where Denham employees are mainly present, such as offices and canteens.

  • Only fixed cameras are installed. Denham does not use camera surveillance through drones, for example.

  • Facial recognition software is not used in camera surveillance.


It is Denham’s policy to inform those involved in advance of the processing of personal data. CCTV usage is explained via signs at the entrance to the property or building where the cameras are located, through this Protocol and by means of the Denham Privacy Policy.

All staff shall be informed prior to the Protocol coming into effect. This Protocol is part of the Denham Privacy Policy.

The legal basis for using CCTV is that it is necessary for the legitimate (business) interest of Denham namely the security of visitors, customers, employees and property.

It has been established that Denham has no other less invasive capabilities than CCTV to secure the locations and/or buildings appropriately and that camera surveillance is part of a total package of measures.

Denham has taken adequate measures to protect the camera images. Denham ensures that camera images are appropriately protected against loss or any form of unlawful use. The camera images are protected. Access control and logging can determine who has accessed the camera images when accessed the camera images.

CCTV footage may only be seen after an incident or suspicion by authorized persons as set below.

Incidents include theft, burglary, vandalism, fraud, property damage, sabotage, (other) crimes, serious violations (of house rules), and events that put persons at risk or otherwise harmed.

Access to the camera footage in the event of (a suspicion of) an incident is limited to the following persons:

  • The Retail Manager and the Store Manager for the Denham stores of Denham.

  • The Human Resource Manager for the offices and the stores of Denham.

  • Employees of the IT company CTS-it and Denham HQ are responsible for securing safety of the stores and offices– this company and its employees are required to keep the camera images secret.

  • Members of Denham’s management.

  • The Data Privacy Officer or the employee responsible for privacy.

In principle, exceptions can be made if submission to third parties is necessary under a legal obligation or if a failure or maintenance of camera registration equipment makes this necessary. After use by the third party, the Retail Manager for stores and Human Resource Manager for the offices must ensure that any copies made are destroyed immediately.

If there is an (alleged) crime, Denham is entitled to provide the camera footage to the police and/or the prosecuting authorities. The Data Privacy Officer or the employee responsible for privacy and the Management jointly will assess whether it is really necessary to provide the camera images.

After capture, camera images are retained for a maximum of seven days unless there has been an incident and the camera footage are used as evidence. A longer retention period may also be necessary if further investigation is required. The camera images will then be kept for as long as necessary in the context of incidents that occurred or as long as necessary for further investigation.

Those involved have the right to access images on which they are recognizable and to request the removal of the data, provided that the rights and freedoms of others are not violated. A request for this can be addressed to the email address: privacy@denham.com. A request for access or retrieval of a copy requires a clear indication of the period on which the person believes that he has been filmed. Denham will respond to the person's request within four weeks.
